Collective Agreement Negotiations


 
The Grondin, Poudrier, Bernier counsellors who specialize in negotiating collective agreements represent unions, which are already certified, in their dealings with public and private enterprises.  Our clients can choose whether the members of the team will play an active role, or act as advisors or counsellors.

 
Active Role: spokesperson or counsellor attending bargaining and possibly conciliation sessions:
  • development of demands;
  • establishing a bargaining strategy;
  • comparative study of working conditions to enable reasonable negotiations.

Advisory Role: support for the bargaining team without direct participation at the negotiating table:

  • advice on group insurance, pension plans, pay equity, duty of accommodation, etc.;
  • legal opinions on various labour laws, social laws, charters, etc.;
  • participation in general meetings;
  • analysis and drafting of demands, offers and counter-offers;
  • direct participation or support for drafting news releases for the media or the members.

Counsellor before arbitrators, civil or administrative courts:

  • arbitration of initial collective agreements or disputes;
  • representation before superior courts in the event of conflicts (strikes, lock-outs, injunctions, contempt of court, etc.);
  • requests for orders or contesting appeals before the Commission des relations du travail or the Conseil des services essentiels.
